Παράταση της Δανειακής σύμβασης σημαίνει παράταση του Μνημονίου......I

Διαβάσαμε σήμερα στον ηλεκτρονικό τύπο (το Βήμα, euro2day, iefimerida κλπ) ότι υπάρχει «συμβιβαστική πρόταση» ώστε να μην χρησιμοποιηθεί η φράση «extend of loan agreement» ή αυτή του «extension of current program» που ζητούσαν οι Ευρωπαίοι ή σκέτο το «loan agreement» που και πάλι επιθυμούσε η Ελληνική πλευρά με τον όρο «master financial assistance facility of Greece» (hellenic master FFA).

Θα ήταν καλό να πληροφορηθούν οι φίλτατοι δημοσιογράφοι που αναφέρονται σε όλα αυτά ότι απλά προσπαθούν να καλύψουν την μέγιστη κυβίστηση πίσω από ΑΝΥΠΑΡΚΤΟΥΣ λεκτικούς ακροβατισμούς.

Ως νομικό, υπογεγραμμένο, κείμενο, ανάμεσα στην Ελλάδα και τους εταίρους πιστωτές της υπάρχει ΜΟΝΟΝ ένα κείμενο με τον τίτλο «master financial assistance facility of Greece» και ουδέν παραπάνω, όσο και εάν θέλουν ή προσπαθούν να ανακαλύψουν καινούριες έννοιες.

Επί του ως άνω νομικού κειμένου έχουν θέσει τις υπογραφές τους εκ μέρους της Ελληνικής δημοκρατίας:

1. Το υπουργείο των Οικονομικών και
2. Η Τράπεζα της Ελλάδος

και εκ μέρους των δανειστών ο EFSF/ESM ενώ ως εγγυητής εκ μέρους της Ελληνικής δημοκρατίας έχει συνυπογράψει το Ταμείο Χρηματοπιστωτικής Σταθερότητας.

Στο παραπάνω κείμενο και στο άρθρο επτά (7) διαβάζουμε:

«A Memorandum of Understanding was entered into between the Commission, the Hellenic Republic and the Bank of Greece on or around 14 March 2012 in relation to this Agreement. The availability and the provision of Financial Assistance under this Agreement, including pursuant to the Facilities (as defined below) made available under the Facility Specific Terms (as defined below), shall, unless otherwise specified, be conditional upon (i) the Beneficiary Member State's compliance with the measures set out in the MoU and (ii) the Guarantors deciding favourably, on the basis of the findings of the regular assessments carried out by the Commission in liaison with the ECB in accordance with the Council Decision of the European Union on the basis of Articles 126(9) and 136 of TFEU on 12 July 2011 (which recast the former Council Decision 2010/320/EU of 10 May 2010 as amended), that the economic policy of the Beneficiary Member State accords with the adjustment programme and with the conditions laid down by the Council in the Decision and any other conditions laid down by the Council or in the MoU. »

Με λίγα λόγια το Μνημόνιο είναι αναπόσπαστο τμήμα της δανειακής σύμβασης και ούτε καν προσάρτημα της.  Εφόσον λοιπόν η Ελληνική κυβέρνηση αιτηθεί την τεχνική παράταση του «master financial assistance facility of Greece» τότε αιτείται αυτομάτως και την παράταση του μνημονίου.

Για να υπάρξει χρηματοδότηση της οικονομίας σύμφωνα με το «master financial assistance facility of Greece» χρειάζεται να τελειώσει η αξιολόγηση των στόχων που είχαν τεθεί από το Μνημόνιο.

Ακριβώς αυτό είχε αιτηθεί και η προηγούμενη κυβέρνηση τον Δεκέμβριο δηλαδή «technical extension of the availability period of the current Hellenic Master Financial Assistance Facility Agreement - Master FFA»

Οτιδήποτε άλλο βρίσκεται στη φαντασία οποιουδήποτε κειμενογράφου.........
